DMCA Policy

Salmon Chowder ("we," "us," or "our") respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines the procedures for copyright holders to notify us of alleged infringement and for users to respond to such notices.

It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. If we receive a valid DMCA notice, we will promptly remove or disable access to the infringing material and take appropriate action against repeat infringers.

Filing a DMCA Notice of Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Salmon Chowder website or service, please send a written notice to our Designated Copyright Agent with the following information (as required by 17 U.S.C. ยง 512(c)(3)):

  1. Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  2. Identification of the Infringing Material: A description of the material that you claim is infringing and its location on the Salmon Chowder website or service, specific enough to permit Salmon Chowder to locate the material. This should include the URL(s) where the material is located.
  3. Your Contact Information: Your name, mailing address, telephone number, and email address.
  4. Good Faith Belief Statement: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy and Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Electronic or Physical Signature: Your electronic or physical signature (e.g., a scanned copy of your physical signature, or typing your full legal name).

Please send your complete DMCA notice to us via our contact page, clearly indicating it is a DMCA notice.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you have the right to file a counter-notification with us. To do so, you must provide a written counter-notification to our Designated Copyright Agent that includes substantially the following:

  • Identification of the Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • Perjury Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your Contact Information and Consent to Jurisdiction: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Salmon Chowder may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Electronic or Physical Signature: Your electronic or physical signature.

Please send your complete counter-notification to us via our contact page, clearly indicating it is a DMCA counter-notification.

Upon receipt of a valid counter-notification, we will send a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored in 10 to 14 business days after receipt of the counter-notification, at Salmon Chowder's sole discretion.
